Massage Therapist Leaving a Spa: Can You Take Clients?

Woman receiving a head massage at a spa, a client a massage therapist may want to keep when leaving a spa

Whether a massage therapist can take clients when leaving a spa depends on the written agreement: a non-solicit may bar you from reaching out, but it does not stop a client from choosing to follow you when they ask on their own. Indiana enforces non-competes only when they are reasonable in time, geography and scope. The clean path is to read the contract first, plan a quiet transition and line up a private room for your own practice before the last shift.

What the rule says

Indiana courts enforce a non-compete only when its time, geography and scope are reasonable, and they strike unreasonable terms rather than rewrite them; independent contractors are judged by the same standard. A non-solicit is a related clause that limits contacting clients, and its wording matters: some forbid all contact, some bar active solicitation but allow answering a client who calls. This is general information, not legal advice, and rules change, so have an employment attorney read your actual agreement.

Read the agreement line by line

Pull your offer letter, handbook and any contractor agreement. Mark:

  1. Non-compete: length, distance and what activity it limits.
  2. Non-solicit: who counts as a client and what contact is barred.
  3. Confidentiality: client lists, booking data and pricing.
  4. Notice period and what happens to unpaid commissions.
  5. Whose property the client records are.

If any term looks unreasonable, say so to an attorney before acting. Do not sign a new agreement on the way out without reading it.

What you can usually do

Action Often safe Check first
Answer a client who asks where you are going Yes If the clause bars even that
Post a general announcement on your own public page Often Whether it names spa clients
Contact clients from a spa list No Almost always risky
Take the booking system export No Treated as business property
Keep your own personal contacts Yes If they came from outside the spa

When in doubt, treat the spa’s client list as theirs and build your own through referrals and public channels.

Tell clients the right way

If your agreement allows it, a short message works: thanks, where you will be and when you start. If it does not, ask your manager how they want departures handled, and give clients the spa’s contact if they ask for you. Be gracious, since a clean exit protects your reputation, and many clients will find you anyway. Avoid disparaging the spa.

A clean first month in your own room

  1. Book trial hours before your last day, and bring your table, linens and playlist.
  2. Set up booking, payments, intake forms and insurance.
  3. Publish a simple page with your services and location.
  4. Open a few evening and weekend slots first.
  5. Track every appointment and its source.

At FlexWerk Carmel, rooms rent by the hour from $18 with no lease, a fitness professional’s first booked hour is free, and each therapist keeps what they charge. See the rent versus commission math for how that compares with commission arrangements. Review your status too, using the 1099 versus W-2 comparison.

Think of the client book as earned, not owned

A related question is what transfers when someone sells a practice, covered for trainers in selling a client list. The principle is the same: what you can take depends on the paper you signed and the privacy rules around health information. Build the next book by earning rebookings, not by raiding the last one.

Related questions

Can I tell my regular clients I am leaving?

It depends on your agreement. Some non-solicit clauses allow answering a client who asks, and others bar outreach. Read the wording and ask an attorney if it is unclear.

Do clients belong to me or the spa?

The contract and the records decide. Booking data and client lists are often treated as business property, while a client's choice of therapist is theirs.

Should I take client files with me?

Not without checking the agreement and privacy rules. Health records have their own obligations, so ask how the spa handles transfers and what the client must sign.
